Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Long-term transaction: A distance contract relating to a series of products and/or services, with obligations spread over time.
  • Durable data carrier: Any tool that enables the consumer or entrepreneur to store information addressed to them in a way that allows future consultation and unaltered reproduction of the stored information.
  • Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
  • Model withdrawal form: The withdrawal form provided by the entrepreneur that a consumer can fill in to exercise their right of withdrawal.
  • Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.
  • Distance contract: A contract in which, as part of an organized system for selling products and/or services remotely, exclusive use is made of one or more means of remote communication until the contract is concluded.
  • Means of remote communication: Any method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.
  • General Terms and Conditions: These general terms and conditions of the entrepreneur.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.
  2. Before concluding the distance contract, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be stated before the contract is concluded where the general terms and conditions can be inspected, and that they will be sent free of charge upon request.
  3. If the contract is concluded electronically, the text of these general terms and conditions may be made available electronically in such a way that the consumer can store them on a durable data carrier. If this is not possible, it will be indicated where the consumer can read them electronically, and they will be sent upon request.
  4. If specific product or service conditions apply in addition to these general terms, the second and third paragraphs apply, and the consumer may always rely on the most favorable applicable provision.
  5. If any provision of these terms and conditions is found to be null or void, the remaining provisions remain in force, and a new provision will be established that closely aligns with the original intent.
  6. Any situation not covered by these terms and conditions will be assessed according to the spirit of these terms.
  7. Any ambiguities about the interpretation of one or more provisions should be interpreted in accordance with the spirit of these general terms and conditions.

Article 4 - The Offer

  1. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
  2. The offer is non-binding. The entrepreneur has the right to modify and adjust the offer.
  3. The offer includes a complete and accurate description of the offered products and/or services. If images are used, they are a truthful representation of the products/services.
  4. All images, specifications, and descriptions are indicative and cannot be grounds for compensation or contract dissolution.
  5. Each offer includes information clearly outlining the rights and obligations associated with acceptance, including:
    • The price, including taxes.
    • Any applicable shipping costs.
    • The process for contract formation and necessary actions.
    • Whether the right of withdrawal applies.
    • Payment, delivery, and contract execution details.
    • Any applicable codes of conduct.

Article 5 - The Agreement

  1. The contract is concluded once the consumer accepts the offer and fulfills the stated conditions, including payment.
  2. If the consumer accepts the offer electronically, the entrepreneur immediately confirms receipt of the acceptance electronically. Until receipt is confirmed, the consumer may dissolve the contract.
  3. If the agreement is concluded electronically, the entrepreneur ensures a secure web environment and appropriate security for electronic payments.
  4. The entrepreneur may, within legal limits, verify whether the consumer can meet payment obligations and examine other relevant factors before proceeding with the contract. If the entrepreneur has valid reasons to decline, they may refuse an order or impose special conditions.
  5. The entrepreneur will provide the following information with the product/service:
    • Business address for complaints.
    • Information on withdrawal rights or exclusion of such rights.
    • Warranty and post-purchase service details.
    • The terms specified in Article 4, unless already provided before contract execution.
  6. All agreements are subject to product availability.

Article 6 – Right of Withdrawal - Not Applicable

Article 8 - Exclusion of Right of Withdrawal

As our products are custom-made (you select the image and size), the right of withdrawal does not apply. This means you cannot return the product once purchased.


Article 9 - The Price

  1. Prices will not increase during the offer’s validity period, except for changes in VAT rates.
  2. Products/services subject to market fluctuations may have variable pricing.
  3. Price increases within three months after contract formation are only allowed if they result from legal regulations.
  4. Prices include VAT.

Article 10 - Conformity and Warranty

  1. The entrepreneur guarantees that products/services comply with the agreement, stated specifications, and legal regulations.
  2. Complaints about defects or incorrect deliveries must be reported in writing within 2 months.
  3. The warranty does not cover:
    • Products repaired or modified by third parties.
    • Products exposed to abnormal conditions or improper handling.
    • Issues resulting from government regulations on materials.

Article 11 - Delivery and Execution

  1. Orders will be executed with care.
  2. Delivery is to the address provided by the consumer.
  3. Orders are executed within 30 days unless an extended delivery time is agreed upon.

Article 15 - Disputes

  1. EU law applies to these terms and agreements.
  2. The Vienna Sales Convention does not apply.
